[Updated] Samsung Isn’t Allowed To Sell the Galaxy Tab 10.1 In Australia Because Of Apple Lawsuit

UPDATE 2: Ok, so maybe Samsung isn’t quite as bold as we thought… After initially reporting that they can’t sell the Galaxy Tab 10.1 in Australia, and then updating the story with a statement from Samsung saying that they WILL sell it down under – It now looks like they are back to NOT releasing it down under, at least for now.

Today, Samsung postponed their Australian media launch even for the Galaxy Tab 10.1. The event was set to take place on August 11, which is next Thursday. Apparently Samsung had previously reached an agreement with Apple saying that they will not release nor advertise the 10.1 in Australia – BUT Samsung found a workaround (diff design and/or components?) and announced that they will be releasing what they called variant the tablet down there. It looks like Apple has since stepped in and Samsung has changed their tune, most likely because even a variant of the device would be against the good faith of the agreement.

No word on a new date for the media event, or whether this means the device’s Australia debut is simply postponed or scrapped altogether.  Samsung’s statement on the postponment reads as follows:

In light of the current legal proceedings by Apple Inc. against Samsung Electronics Australia, Samsung regrets to announce it will be postponing its media launch event, scheduled for 11th August 2011, for the Samsung GALAXY Tab 10.1.

Samsung will announce a new date for the GALAXY Tab 10.1 media launch event as soon as practicable.

And the plot thickens…

UPDATE: In a rather bold move, Samsung has stated that it will continue with its plan to release the Galaxy Tab 10.1 in Australia, despite Apple’s attempts to halt sales through Aussie Federal Court. Sammy explains that Apple’s patent complaints only relate to the US variant of the tablet, which they do not plan to sell in Australia anyway. Apple Inc. filed a complaint with the Federal Court of Australia involving a Samsung GALAXY Tab 10.1 variant that Samsung Electronics had no plans of selling in Australia. No injunction was issued by the court and the parties in the case reached a mutual agreement which stipulates that the variant in question will not be sold in Australia.

A Samsung GALAXY Tab 10.1 for the Australian market will be released in the near future.

This undertaking does not affect any other Samsung smartphone or tablet available in the Australian market or other countries.

Samsung will continue to actively defend and protect our intellectual property to ensure our continued innovation and growth in the mobile communication business.

It looks like the lawsuit Apple has placed against Samsung is hurting the company a little bit. According to the US lawsuit Samsung must present a new product to Apple at least seven days in advance for Apple to review. In Australia they didn’t allow the same to happen while the suit was going on, so the device is on hold while Apple tries to force its way to more profits by really non competitive means.
